AI Emotion Recognition: What German Companies Need to Know

Emotion recognition AI is one of the most restricted categories under the EU AI Act. In many contexts, it’s outright prohibited. In others, it faces the strictest compliance requirements.

If you’re using or considering emotion recognition technology, you need to understand these limits.

What’s Prohibited

The AI Act bans emotion recognition in workplaces and educational institutions. Period. You cannot use AI to infer employees’ emotional states from facial expressions, voice patterns, body language, or other biometric signals at work. The same applies to students in schools and universities.

This prohibition is already in effect as of February 2025.

Limited Exceptions

Emotion recognition isn’t entirely banned. Medical and safety applications have narrow exceptions—for example, detecting driver drowsiness for safety purposes, or clinical applications for patient monitoring.

But these exceptions are narrow and require careful compliance work. “We think it would be useful” isn’t a justification.

Workplace Implications

German employment law already restricts employee monitoring, but the AI Act goes further. Works councils have been skeptical of emotion recognition for years—now it’s explicitly illegal in most workplace contexts.

If you have any systems that analyze employee emotional states—even indirectly—audit them now. Customer service sentiment analysis that touches employee performance evaluation is problematic. Interview tools that assess candidate emotions are prohibited.

What About Customer-Facing Uses?

Emotion recognition for customers isn’t banned, but it still requires careful compliance. Transparency is mandatory: customers must know their emotions are being analyzed. And if the data is used for consequential decisions, high-risk requirements may apply.
